PLANNING BOARD MEETING-DRAFT

 

ON November 2, 2017 the regular meeting of the Springfield Planning Board was held at the community center.

 

Present were:

Laura Sikkema, Rob Freeland, Priscilla Barry

Jeannette Armstrong, Michelle Kennedy, Sherri Falcone

 

Guests:

George and Tina Macaluso, Jerome and Regina Oakes, Dennis Laughlin, Attorney, Tracy Law Office, Cherry Valley

 

Sikkema called the meeting to order at 7 PM.

 

The first order of business was the Macaluso application.  Kennedy stated that a quorum for the Zoning Board of Appeals was being formed.  She informed the Macaluso’s that their application will require an area variance from the ZBA since an expansion of a non-conforming use is not allowed in the zoning law.  She discussed various factors associated with their application under Section 267B of the New York State Town Law paragraph 3.  Kennedy will email the criteria to the Macalusos.

 

The ZBA has to address five factors: property line setbacks, an explanation of why their layout is the only possibility, explore other possibilities, what is the minimum variance to achieve their goal, placement of the garage, and Kennedy requested elevation drawings.  After they secure the special use permit from the ZBA they were advised to meet with Falcone when the application is complete and then return to the planning board.  The Type of Action, the historical register, and the agricultural district were also discussed

 

The Deis application for a lot line adjustment, that is being handled by Attorney Laughlin, was also referred to the ZBA for a variance.  He will bring maps when he returns to the planning board.

 

The county code office will not renew the 2009 Hallberg permit again.  Since there is only a shed, the process will move forward.

The minutes could not be approved again because certain members were not present.

 

The new ZBA members are H.G. Dillingham, Tara Sumner and Justin Hobbie but they still have to take the oath of office.

 

Brochures were available about the Route 80 culvert over Trout Creek and the recommended detours for the area.  Work will begin next year after the Opera shuts down.

 

A motion was made by Barry and seconded by Freeland to close public comment.

Voted, carried, all votes aye.
